Jdimytai Damour was a 34-year-old worker at a Long Island Walmart during the "Black Friday" Thanksgiving sales season. He was killed when a mob of shoppers broke down the doors of his store and trampled him to death.
An OSHA investigation into Damour's death found that Walmart could have prevented it simply by taking some basic steps to manage the crowd they themselves created. However, even though with this finding, OSHA could only fine them a maximum of $7,000 because of weak protections for workers in the law.
The Protecting America's Workers Act is legislation before Congress that would strengthen those protections -- including increasing the minimum fine for deaths in cases such as Damour's to $20,000.
